Houseboat Regulations
§ 1 General Provisions
1. These Regulations specify the terms of providing short-term accommodation by the Lessor on a Houseboat (hereinafter referred to as a mobile house on water) in accordance with the current offer, which is the subject of the Agreement, as well as the rights and obligations of the Lessor and the Tenant, as well as the Guests and other persons staying on the premises of the mobile house on water resulting from the concluded Agreement.
2. These Regulations are available to interested parties on the website www.hotelpirat.com.pl in such a way that, according to their request, before making a preliminary reservation and concluding a short-term rental agreement for the mobile house on water, they can obtain, reproduce, record, and store them.
3. Terms used in the Regulations mean:
1) Lessor – Przedsiębiorstwo Handlowo Usługowe Andrzej Antoniuk with its registered office at ul. Bałtycka 95, 10-180 Olsztyn, Warmińsko-Mazurskie Voivodeship, tax ID number NIP 7391511109, acting personally or through an authorized person,
2) Booker - a natural person, legal person, or organizational unit without legal personality, making a preliminary reservation of the mobile house on water.
3) Tenant - a natural person, legal person, or organizational unit without legal personality concluding a short-term rental agreement of the mobile house on water with the Lessor.
4) Guest - a natural person for whom the reservation has been made, enjoying the rented mobile house on water during the period covered by the Agreement,
5) Agreement – means the short-term accommodation agreement concluded between the Lessor and the Tenant, including also using remote communication means, which comes into effect at the moment the Tenant pays the agreed non-refundable deposit to the Lessor;
6) Pirat - designates the facility with available infrastructure located in Olsztyn at ul. Bałtycka 95
7) Deposit - a specified amount of money in the Regulations securing the Lessor's claim against the Tenant and his Guests in the event of damage to the rented Houseboat and on the premises of Pirat for which the Guest or Tenant is responsible,
8) Accommodation Fee - the sum of all fees for the stay in the mobile house on water during the agreement period, in accordance with the provisions of these Regulations and the Price List,
9) Lessor's bank account - bank account number: 49 1020 3541 0000 5402 02810745
4. Before making a reservation and concluding a short-term rental of the mobile house on water, the Tenant is obliged to familiarize themselves with these Regulations and the Price List and confirm acceptance of their content and conditions.
5. The price of services provided by the Lessor does not include insurance.
§ 2 Reservation rules and payment conditions
1. Preliminary reservations are made by sending a request to the Lessor via online services: www.booking.com, on the website www.hotelpirat.com.pl (in accordance with the regulations of these services), by phone at: 500 411 443, by email: rezerwacja@pirat.com.pl or personally at Pirat.
2. The request referred to in § 2 sec. 1 should include the following data:
(a) the name and surname or company name of the Tenant and their address, including email address for correspondence and contact phone, and additionally — if the Tenant wishes to receive a VAT invoice — Tenant's data for issuing a VAT invoice, including their VAT number (NIP) and the Tenant's statement consenting to receive the invoice electronically at the specified email address
(b) the number, as well as the names and surnames of Guests, including the number of underage Guests;
(c) the exact period of the stay;
(d) a statement that at least one of the Guests is an adult;
(e) a statement of consent to the processing of personal data provided to the Lessor upon booking;
(f) a statement that the Tenant and Guests have read and accepted the content of these Regulations and the Lessor's Price List.
3. It is unacceptable to make a reservation of the mobile house on water exclusively for underage Guests. 4. Direct reservation at Pirat is allowed on any available day depending on availability and preparation capacity.
5. The condition for finalizing the reservation is the receipt of payment on the Lessor's bank account within 7 days from the reservation, of the total rent amount for the reserved period.
6. Making the payment results in the Tenant entering into a short-term rental agreement for the mobile house with the Lessor, under the terms specified in these Regulations and the Price List, and means acceptance by the Tenant and Guests of the content of the Regulations and Price List.
7. Failure to timely credit the amount specified in the previous sentence to the Lessor's account is equivalent to the Tenant canceling the final reservation of the mobile house on water and results in the Lessor withdrawing from the agreement and retaining the deposit paid by the Tenant.
8. In the transfer description of the amount referred to in § 2 sec. 5 point 1, please specify: rental of the mobile house on water (deposit), stay date, name and surname or company name of the Tenant.
9. After concluding the agreement, the Lessor requires the client to pay a deposit or provide security in the form of a credit card guarantee or similar. If payment is not made within the agreed period, the Lessor may withdraw from the Agreement and demand compensation for damages in addition to retaining the deposit. Therefore, the Tenant authorizes the Lessor to charge amounts equivalent to its claims from accounts held for the designated cards within 14 days from the return of the mobile house on water, with the reservation that the amount charged as the deposit shall not exceed 1,500.00 PLN. The deposit will be returned to the Tenant immediately after the return of the rental item in an undamaged condition.
10. In justified cases (e.g., client payment arrears or extension of the agreement scope), the Lessor may demand an increase in the advance payment, deposit, or secured amount up to the expected rental costs.
§3 Withdrawal from the agreement and reservation cancellation
1. Both the Tenant and the Lessor have the right to withdraw from the rental agreement of the mobile house on water up to 7 days before the agreed payment date for the Houseboat, without incurring any additional costs,
2. In case of cancellation or annulment by the Tenant of the final reservation of the Houseboat, or termination of the rental agreement by the Tenant for reasons beyond the Lessor's control, the deposit paid by the Tenant is non-refundable.
3. Declarations by the parties mentioned in § 3 sec. 1 and 2 should be made in writing or by email, and the date of sending by email is considered the date of delivery.
4. The Lessor allows the possibility of changing the rental period by the Tenant after prior agreement between the Parties, including settlement terms of the already concluded rental agreement. In such case, the Tenant is not entitled to withdraw from the agreement under § 3 sec. 1.
§4 Deposit and additional fees
1. During the registration duty, the Tenant and Guests must pay a Deposit as specified in § 1 sec. 3 point 7 and § 2 sec. 10 in the amount of 1,500.00 PLN
2. The deposit will be fully refunded upon the Tenant's check-out, provided no damages or shortages are found in the mobile house or Pirat premises for which the Guest or Tenant is responsible.
3. In case the Lessor is called to repair damage caused by the Tenant or Guests, the Lessor has the right to deduct an amount of 500 PLN (this fee is not a repair cost, which are charged separately to the Tenant).
4. If the Tenant fails to return the Houseboat after the rental period, an additional day's rental fee will be automatically charged.
5. If the Tenant violates the smoking ban in the mobile house, a penalty of 1,000 PLN may be deducted from the deposit.
6. If the Tenant clogs the sewage pipes in the mobile house, 500 PLN may be deducted from the deposit.
7. If insurance refuses to pay due to the Tenant's actions or omissions, the Lessor will charge the Tenant for the full amount of damage.
8. In case of loss, destruction, or damage to the mobile house, including paintwork damage, the Tenant will be liable for part of the damage.
9. In case of damage or loss of equipment, the deposit will be retained until costs are settled, equipment replenished, or damage accounted for by the Lessor.
10. Additional damage costs:
a) lost key – 50.00 PLN each
b) lost remote control – 100.00 PLN each
c) lost life jacket – 200.00 PLN each
d) lost boat hook – 200.00 PLN each
e) lost rope – 300.00 PLN each
§5 Check-in and check-out
1. Check-in and check-out of Guests is done in the presence of the Lessor or an authorized person. The rental day starts at 3:00 PM and lasts until 11:00 AM.
2. Check-in takes place on the first day of the rental period. 3. The conditions for Guest check-in are:
1) booking payment fully credited to the Lessor's account,
2) presentation of identity documents by Guests to the Lessor
3) signing by Guests of the mobile house acceptance form, indicating the condition of the house and the type, number, value, and state of equipment,
4) each Guest’s statement of having read the GDPR information clause;
5) signing the boat rental agreement;
4. In case of defects, irregularities, or faults in the condition or equipment of the mobile house, the Tenant and Guests must indicate this when checking in or inform the Lessor within the first hour of stay. 5. Upon receiving the keys, the registered Guests who signed the acceptance form become materially liable to the Lessor for the items handed over to them under the rental agreement.
6. The Lessor has the right to refuse accommodation to Guests who:
1) are visibly under the influence of alcohol or narcotics,
2) behave aggressively or in a widely considered vulgar manner.
7. Check-out takes place on the last day of the rental. By the time specified in the rental agreement, all Guests must vacate the mobile house.
8. If any damage, destruction or loss is found upon check-out for which the Guests are responsible, the Lessor and Guests shall prepare a report specifying the kind and value of damages. If the Guest refuses to sign, the report signed by the Lessor is deemed valid for both Parties.
§6 Guest stay rules
1. Each Guest is obliged to:
1) comply with these Regulations and the instructions of the Lessor or Pirat staff;
2) maintain the rented mobile house and Pirat premises in proper condition,
3) secure the rented mobile house every time by turning off electrical devices, lights, closing taps, and locking windows and doors with a key when leaving,
4) store the mobile house keys to prevent access to third parties and immediately inform the Lessor in case of loss or theft,
5) dispose of all generated waste only in containers in designated places within the mobile house and Pirat premises,
6) immediately inform the Lessor of any damage caused by the Guest on persons or property for which the Guest is responsible,
7) park their vehicle on Pirat premises only in designated parking spaces,
2. On Pirat premises:
1) quiet hours apply from 10:00 PM to 6:00 AM; exceptions are possible during special hotel events like weddings, banquets, outdoor events, which will be announced on the hotel reception notice board,
2) children and youth under 18 may stay only under adult supervision,
3) smoking is completely prohibited; any violation by the Tenant or Guest will result in a 1,000 PLN fine,
4) visitors may stay in the Houseboat between 8:00 AM and 10:00 PM;
5) use of open flames (e.g., candles, lanterns, fireworks) and personal electric or gas stoves in the mobile house is prohibited,
6) pets are not allowed in the mobile house.
3. The Lessor commits to provide Guests with bed linens,
4. Subleasing, lending, or inviting others to the rented mobile house requires prior written consent from the Lessor.
§ 7 Liability
1. The Lessor is not liable legally or materially for:
1) injuries not caused by the Lessor and damage or theft of Guest property or vehicles on the premises of the mobile house and Pirat. It is Guests’ responsibility to safeguard their possessions and lock windows and doors when leaving.
2) temporary inconveniences caused by external utility providers, e.g., water pressure drops, power outages,
3) items left or lost by Guests on Pirat premises. Lost items found will be handled in accordance with Polish law on found items (Act of February 20, 2015, consolidated text Journal of Laws 2019, item 908),
4) consequences of incorrect data provided by the Booker or Tenant during booking.
2. Guests are financially liable for damages caused by themselves or their visitors on Pirat premises, including unintentional damages owing to violation of these Regulations.
3. In case of serious breach of these Regulations by a Guest, the Lessor has the right to unilaterally shorten the Guest's stay and order immediate departure from Pirat without any right to compensation.
4. In the case described in sec. 3, payments made for the rent are non-refundable.
5. The Lessor is not liable for non-performance or improper performance of the agreement due to force majeure beyond its control.
6. The Tenant is obliged to insure themselves for Civil Liability.
§ 8 Final provisions
1. Matters not regulated by these Regulations are subject to the provisions of the Polish Civil Code and other generally applicable laws.
2. The Lessor reserves the right to amend these Regulations. The Tenant will be informed by posting the changes and new content on the Lessor's website and by sending the new Regulations to the Tenant's email if provided. Changes take effect 14 days after posting unless the Tenant objects within 14 days by email, in which case the previous Regulations remain binding.
3. Any disputes between the Lessor and the Tenant or Guests, if not resolved amicably, shall be settled by the competent common court.
4. Complaints related to non-performance or improper performance of the agreement may be submitted by the Tenant within 3 days from the date of fault detection to the Lessor's email rezerwacja@pirat.com.pl and should include current Tenant data and a concise description of complaints. The Lessor shall consider the complaint within 30 working days from submission.
5. The Lessor is the data controller of personal data of the Booker, Tenant, and Guests made available during booking and check-in of the mobile house. The data is stored and processed by the Lessor in order to execute the rental agreement, as specified in the information clause.
